What is a red-light running violation?

A red-light running violation occurs when a motorist enters an intersection after the traffic signal has turned red. Motorists already in the intersection when the signal changes to red, waiting to turn for example, are not considered red-light violators.

How does the red-light safety camera work?

• The system activates when motion is detected just prior to the stop bar AFTER the traffic signal has turned red. The cameras capture two images of an alleged violation, taken from the rear of the vehicle.
• The first image shows the vehicle at the white stop bar and the illuminated red light.
• The second image shows the violator in the middle of the intersection with the red light illuminated.
• The license plate image is a close-up from one of the images captured.
• Data, including the time, date, and duration of the yellow and red lights, also is recorded.
• Cameras also record a 12-second digital video of the violation, including six seconds prior to and six seconds after running the red light.

Why did I receive this Notice of Violation?

Based upon images captured by a red-light camera system and then reviewed by local law enforcement, your vehicle was determined to have committed a red-light violation. As the vehicle owner, the (NOV) is mailed to you.

How much is the fine?

The civil penalty for this traffic infraction is $158.00 if the violator pays within sixty (60) days of the postmark date of the NOV. No points will be assessed against your driving record as a result of this infraction.

When is my payment due?

The due date is listed on the front of the Notice. The payment coupon also will have the due date listed. When mailing in a payment, allow 10 days in order to be received in a timely manner.

What are my options?

1. Pay the fine
   1. Pay Online. Logon to www.ViolationInfo.com by entering your Notice number and PIN number shown in the red box on the front right of your Notice. Click the Pay button. There is a convenience fee of up to 5% of the total fine amount that will be assessed at the time of payment.
   2. Pay by Mail. Your payment must be received before the due date on the front of your Notice. Mail your check or money order in the envelope enclosed with your Notice. Include the coupon from your Notice. Put the license plate number on your check or money order. DO NOT MAIL CASH (Cash payments will not be accepted). 2. Request a Hearing

3. Submit an Affidavit of Non-Responsibility
   You may download an affidavit at www.ViolationInfo.com. As the registered owner of the vehicle, you are deemed responsible for the violation and the payment of a $158.00 penalty unless, in compliance with Florida Statute § 316.0083(1)(d)1.a-d, you establish by a sworn affidavit that a statutory exemption applies.
   The exemptions are that the motor vehicle:
   1. passed through the intersection in order to yield the right-of-way to an emergency vehicle or as part of a funeral procession;
   2. passed through the intersection at the direction of a law enforcement officer;
   3. was, at the time of the violation, in the care, custody, or control of another person; or
   4. a Uniform Traffic Citation (“UTC”) was issued by a law enforcement officer to the driver of the motor vehicle for the violation of Florida Statutes sections 316.074(1) and 316.075(1)(c)1.
      
      The affidavit must be sworn before a notary public or other person authorized to administer oaths. If you assert that the vehicle was in the care, custody, or control of another person, you must provide the name, address, date of birth, and, if known, the driver’s license number of the person who leased, rented, or otherwise had care, custody, or control of the vehicle at the time of the violation. If the vehicle was stolen, then the affidavit must include a copy of a police report showing the vehicle to have been stolen. If you assert that a UTC was issued by a law enforcement officer for the violation of Florida Statutes sections 316.074(1) and 316.075(1)(c)1 stated in this Notice, then you must include the serial number of the UTC. For faster processing, you may, but are not required to, include a copy of the UTC. If your affidavit complies with the requirements of Florida Statute § 316.0083, then no further action will be taken against you.
      
      The submission of a false affidavit is a misdemeanor of the second degree, punishable under Florida Statute section 775.082 or section 775.083 by a term of imprisonment not to exceed sixty (60) days and/or a fine not to exceed $500.00.
      
      If submitting an affidavit, it must be postmarked on or before the due date specified on the front page of this Notice in order to be appropriately processed.

4. What if I was not the driver/owner of the vehicle at the time of the violation?
   1. Per the Town of Medley you may request a hearing and submit an Affidavit of Non-Responsibility by mail. The Affidavit must be filled out accurately and in its entirety. You may obtain this form either by downloading and printing the form from www.ViolationInfo.com or visiting the Court in person. Bring the completed form to the Court in person on your hearing date.
5. What happens if I ignore the Notice of Violation?
   
   Failure to pay the civil penalty, request a hearing or to contest liability prior to the due date on the Notice of Violations will result in the issuance of a Uniform Traffic Citation. Upon issuance of a UTC, you shall have the remedies specified in Florida Statutes sections 316.0083 and 318.14, which include:
   1. the right to pay the civil penalty in the amount of $277.00;
   2. the right to submit an affidavit; or
   3. the right to have a hearing before a designated official, who shall determine whether an infraction has been committed. If the official concludes that no infraction has been committed, the UTC will be dismissed and no costs or penalties shall be imposed. If the official concludes an infraction has been committed, the official will uphold the UTC and may impose an additional civil penalty not to exceed $500.00 and court fees and costs. Failure to pay, submit an affidavit, or request a hearing on the UTC could result in your driving privileges being suspended.

How long will it take for my payment to post?

If mailing your ticket, allow at least 10 days for mailing and processing. For online payments, allow 24 hours for payment posting when using a credit card. If you are using a debit card or eCheck, the processing time is 72 hours.

What is a UTC (Uniform Traffic Citation)?

Specific to Florida, a UTC is issued directly from the town to the registered owner of the vehicle for failure to respond to the initial Notice of Violation.

Why did I get the UTC (Uniform Traffic Citation)?

UTC’s (Uniform Traffic Citations) are issued for intersection safety red-light violations pursuant to State of Florida statutes when a registered owner of the vehicle has either failed to pay a Notice of Violation, or because the car owner receiving a Notice of Violation filed an affidavit confirming the identity of the driver for a specific citation.

I received a UTC (Uniform Traffic Citation) and the amount due increased.

Once a UTC is issued it accrues court costs from the state.

Can I contest the citation after a UTC (Uniform Traffic Citation) has been issued?

Yes. On the issued UTC, check option B in the lower left hand corner, sign and date the Notice on the right hand side above the images and return to the address within the option B paragraph.

What company provides the red-light safety camera program in the town?

The Value of Red-Light Safety Cameras

Data from other cities across the country and multiple research studies have proven that red-light safety cameras decrease accidents– in particular, the numbers of side or T-bone crashes which cause the most fatalities and serious injuries.

• In 2011, 712 people were killed and more than 100,000 were injured in intersection crashes.
• Two-thirds of the people that die in red light crashes are people other than the violator.
• Motorists are more likely to be injured in a red-light running crash than any other type of collision.
• An average of nearly 63 people (62.5) died in red-light running crashes every month for the past five years, 2007-2011.
• Cameras change drivers’ behavior: Nationally, there were 520 fewer intersection fatalities in 2010 than in 2009, a 7.1% reduction, even though Americans drove 46 billion miles more in 2010 than in 2009.

In Florida:

• Red-light running crashes killed 81 people in Florida in 2011. A 13% decrease from the 93 fatalities in 2007, according to the National Center for Statistics and Analysis, an office of the National Highway Traffic Safety Administration. Nationwide, red-light running fatalities decreased 22% across the same time period.
• The 789 intersection-related fatalities in 2010 cost the state’s communities more than $4.7 billion.
• Statewide, the presence of red-light safety cameras is changing driver behavior as demonstrated by the fact that of all red-light running citations issued in Florida in 2011, 94% were issued to the same vehicle only once.
• Pursuant to the Mark Wandall Traffic Safety Act, authorities in Florida using red-light safety cameras are to issue $158 fines for running a red light. Each fine is distributed this way: $100 goes to the state’s general revenue fund; $45 goes to the local government; $10 goes to local trauma centers and $3 is allocated for spinal and brain injury research through The Miami Project.

Insurance Institute for Highway Safety

In February 2012, the Insurance Institute of Highway Safety published research that confirmed what many of us already knew-- red-light safety cameras save lives.

• Red-light cameras saved 159 lives in 2004-08 in 14 of the biggest US cities, a new analysis by the Insurance Institute for Highway Safety shows.
• Had cameras been operating during that period in all large cities, a total of 815 deaths would have been prevented.
• The researchers found that in the 14 cities that had cameras during 2004-08, the combined per capita rate of fatal red light running crashes fell 35 percent, compared with 1992-96.
• The rate of all fatal crashes at intersections with signals — not just red light running crashes — fell 14 percent in the camera cities and crept up 2 percent in the non-camera cities. In the camera cities, there were 17 percent fewer fatal crashes per capita at intersections with signals in 2004-08 than would have been expected.
